Terms and Conditions

Please read the following disclaimer carefully before using our website or mobile application. It contains important information about your rights and obligations as well as limitations and exclusions that apply to your purchases. We reserve the right to change the Terms and Conditions at any time. Any such changes will take effect when posted on the Website/Application. By using the Services, you automatically agree to the Terms of Service. If you do not agree with all the terms and conditions, please refrain from further use of the Platform.

1. Terms of Use

The Website can be used only by persons who can form legally binding contracts under applicable law. Persons who are incompetent to contract are not eligible to use the Website. If your age is below that of 21 years your parents or legal guardians can transact on behalf of you if they are registered users/members. We reserve the right to terminate your registration and refuse to provide you with access to the Website if we discover that you are under the age of 21 years. The Website cannot be accessed to persons whose registration has been suspended or terminated by us for any reason whatsoever. Those who choose to access this Website from outside the Arab Republic of Egypt are responsible for compliance with local laws if and to the extent local laws are applicable. We will deliver the products only within the defined area in Egypt as per the delivery policy applicable at the time and will not be liable for any claims relating to any products ordered from outside its jurisdiction.

2. Customer Data

All the data provided must be accurate. Providing any inaccurate data constitutes a breach of these Terms and Conditions. Data collected is treated as confidential and in good faith. When registration is made, your data is collected for business and marketing purposes in the form of personal information such as name, phone number, address, e-mail address, password and payment information in the case of paying using card. The data required for registration provided by the user must be complete and accurate. The user is responsible for updating his/her data that can be amended at any time from the respective interface of the Service.

3. Orders & Prices

Orders must be received before posted cut-off times for a given delivery time. The range and prices of items may differ depending on the delivery location, and AlRayah Market reserves the right to change prices as to update them at any moment. Modified orders are subject to price changes and a change of delivery date may not guarantee the availability of your desired items. Some orders might be cancelled due to limitations on quantities available for purchase, inaccuracy or errors in product or pricing information, or problems identified by our relevant department. Cancellation of orders must be made before the order status is “out-for-delivery”. You can check the status of your order by selecting “My Order” from the drop-down menu of “My Account” tab. If your order is cancelled after the payment, then the Company will refund the amounts in your account wallet.

The User may not be able to edit the order once it has been out-for-delivery as per the technical features provided by the Service. If any product you order is out of stock or unavailable, we may offer you substitutes within the same price range you ordered that you may reject or accept. In case of a higher valued accepted replacement, you will have to pay the price variance. If an item is not delivered, despite being billed, the amount in question will be credited to the User wallet account. No subsequent delivery is obligatory to be made, and the customer is not entitled to claim any further compensation.

If your order contains goods that may be charged by weight (fruit, meat, cheese, etc.), the per-item price you see in your shopping cart is based on an estimated weight. The final price of these variable weight items will be based on the same price per gram/kilogram indicated at time of checkout. The actual price charged is determined once we have prepared and weighed your order, and that actual price will appear on the invoice issued to you on the day of your delivery. Any money owed to you by AlRayah Market due to variance in weighted items will be refunded to your account wallet.

For your convenience, you will not be charged until your payment method (other than cash payment) is authorized; and the order information is verified for accuracy. Frozen items must immediately be placed in a freezer. In an effort to meet the committed delivery times for all of our customers, our delivery personnel cannot wait for an inspection of the items delivered. We reserve the right, at our sole discretion, to limit the quantity of items purchased per person, or per order. The limitations may be applicable to orders placed by the same account, the same credit/debit card, and also to orders that use the same billing and/or shipping address or customer ID. We will provide notification to the customer should such limits be applied. In case of requested refund or exchange, the decision on refund will vary on case to case basis, the After Sales Service Office is the sole reference for any claim of exchange or refund.

4. Delivery

To receive your order, you must be present at the delivery address you submitted. An authorized representative can accept your goods when you are not present and shall accept the goods under all of the same terms and conditions that you had accepted yourself. In case of no-show, we will use commercially reasonable efforts to contact you and reschedule delivery for the same day. In such case, if we are unable to redeliver the order for any reason, the order will be cancelled.

In the event of a non-delivery occurs on account of a mistake by you (i.e., wrong name or address or any other wrong information), any extra cost incurred by us for redelivery shall be claimed from you. If, for reasons beyond AlRayah Market’s control - such as an incorrect delivery address, lack of an access permit, bad weather conditions, or similar, it should prove impossible or possible only with great difficulty, to carry-out the delivery successfully, AlRayah Market is entitled to cancel the User’s order. In this event, the User is not entitled to the compensation, however; in case of online payment, the refund will be initiated at the soonest possible post the cancellation of the order.

Though we make sure that the delivery of purchased products shall be delivered on time, no claim, penalties, refunds or part refund against us in case of delays in delivery or error in delivery. Although we aim to offer you the best service possible, sometime a fault occurs in our services. If a fault occurs, you shall report it immediately to the Customer Services by phone at 16508.

5. Communications

As a customer, when you register on our website/application you agree to receive communications from us electronically. We will communicate with you by emails, SMS, mobile or by posting notices on the Website/application. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. Before accepting any order, we may also require additional verifications or information. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order.

6. Disclaimer

We may at any time modify the Terms and Conditions of the Website without any prior notification to you. You can access the latest version of the Terms and Conditions at any given time on the Website. In the event the modified Terms and Conditions are not acceptable to you, you should discontinue using the service of the Website. However, if you continue to use the service you shall be deemed to have agreed to accept and abide by the modified Terms & Conditions of this Website.
